Clearly, Adam is not the only one who thinks that if it looks like a duck, quacks like a duck and walks like a duck, then it must be a duck.

This affair must be dealt with, promptly, properly and in a manner where all the facts are seen to have been considered. Not another report which would, for it’s use of circumlocution and mis-direction make even Sir Humphrey Appleby purr in admiration.

    Adam: I moveed the whole matter into the sphere of Police. Today’s outcome of the Field case is such that it gives a glimmer of hope in that the Immigration Service Scandal may eventually find itself in a High Court.

    Dear Police Commissioner Howard Broad.

    I am laying with you a formal complaint of an allegation of breaches of the Crimes Act 1961 that pertain to Section 99 Bribery and Corruption and that you need to apply to those members of the Immigration Department who are the subject of present media reports, including those of statements by Members of Parliament

    Ever since the “lie in unison” scandal it has been apparent not all has been well with the NZ Immigration Service. As more is revealed over the preferential treatment given to family members of the NZIS Head, the need for a full inquiry into NZIS grows.

    The present scandal has criminal aspects to it that can only be investigated by the police. The actions of the head of the NZIS must be examined. Her support for the application – “A conflict of interest matter” although ill advised, is not necessarily being questioned but rather it is the route that the application followed to arrive on the Senior Officials desk for him to deal with, that is the real issue, along with the manner in which it was expedited to jump the queue.

    The Family of the Head of NZIS was advantaged to the disadvantage of other applicants. The application was late and the quota had been filled. Immigration staff were ordered by a senior official to override normal policies to process late residency

    From experience you are familiar with the following sections of the Crimes Act: Section 25 – Ignorance of the Law and Sections 99 – Bribery and Corruption, with the following explanatory notes:

    Official means any person in the service of Her Majesty in right of New Zealand (whether that service is honorary or not, and whether it is within or outside New Zealand), or any member or employee of any local authority or public body, or any person employed in the Education service within the meaning of the State Sector Act 1988.

    105 Corruption and bribery of official

    (1) Every official is liable to imprisonment for a term not exceeding 7 years who, whether within New Zealand or elsewhere, corruptly accepts or obtains, or agrees or offers to accept or attempts to obtain, any bribe for himself or any other person in respect of any act done or omitted, or to be done or omitted, by him in his official capacity……..

    MAT is, I believe, a member of the Labour party, or so I have been assured. As such, it is not in the public interest to pursue it any further. Do I make myself clear, or do the purveyors of these leaks need reminding about the police powers to recover stolen information ? I can assure everyone that Dr Prebble will be quite thorough in his approach and will ensure that Ms Thompson is not victimised. Her opponents may not be so lucky.

    Well said Adam. I found your first post on this scandal most enlightening, and have posted my own thoughts at Keeping Stock.

    One thing should be a given – Dr Mark Prebble, now in the twilight of his public service career should totally absent himself from the SSC inquiry – he is too closely linked to Mary Anne Thompson, and regardless of the outcome, the inquiry would be compromised by that, even if his involvement was only reporting back the findings.
