Brash criticizes Police over email case

Tracy Watkins has a piece on how the police despite supposedly closing the investigation  into the theft of emails from Don Brash, which formed much of the basis for Nicky Hager’s ‘book’ The Hollow Men refuse to release the file despite previously saying they would do.

In the latest letter rejecting a request to release the file under the Official Information Act, police have cited the need to protect confidential informants. They have also insisted that the investigation remain open, despite a statement a year ago by outgoing police inspector Harry Quinn that the investigation was closed.

Dr Brash said yesterday that he was told by Mr Quinn as he was wrapping up the case that he would be sent a copy of the police file but, a year on, he had seen nothing.

Watkins notes that the police have stonewalled the Dominion Post for a year and now claim the OIA has been ‘lost’.

So just what is going on. Did they leave the file with the Mongrel Mob? perhaps they gave it to Hager! Why do the police not want to release the file?

    I heard Brash on Moaning Report this morning. From what he was saying the police did not seem to make many inquiries at all. He suggested that if it was Helen’s emails that had gone missing, there would hve been heavy footed police boots everywhere

    My guess, for what it is worth, is that the soon-to-be-retired officer handed this case did a woeful job, and none of his superiors at the time noticed. They don’t want to let the report out, as it will put the professionalism of the police under even more of a cloud.

    This kind of ‘small-c conspiracy’ is endemic in large organisations, where dismal performance can be overlooked for a long time. It is certainly far more common that plots to undermine the government or skew an election.

    Reading Watkins article it seems Hager was not even interviewed by the Keystone Kops until very late in the day, in fact as the article notes:-

    Hager confirmed yesterday that police interviewed him some time after Dr Brash complained that he had not yet been spoken to. Police began an investigation in September 2006 and wrapped it up in April last year.

    Quite frankly something smells about this.

    I am still at a loss to understand why Nicky Hagar was not arrested and charged over this. Possible charges (under the Crimes Act 1961)could include

    * S228 – Dishonesty using a document for pecuniary gain
    * S240 – Obtaining by deception
    * S246 – Receiving
    * S249 – Accessing computer systems for dishonest purpose
    * S312 – Accessory after the fact to crime

    This matter has not been given the serious attention it deserves by the police or media. Either parliamentary computer security was breached from outside and so either is still being breached or could be; or someone breached it from inside and s/he might still be there.

    Thousands of people email MPs every day on personal matters which they would not want read by anyone but the intended recipient.This matter should be cleared up for their sakes as well as for that of the politicians who can have no confidence that their emails aren’t being read by others.

    The behaviour of the police in this matter is absolutely disgraceful. I think that politicians should interfere in police business on very very rare occasions only. This is one of those occasions.
